MEMORANDUM OF UNDERSTANDING on cooperation in the field of information and communications technologies between the Government of the State of Qatar and the Government of the Republic of Azerbaijan
The Government of the State of Qatar and the Government of the Republic of Azerbaijan hereinafter referred to as "the Parties",
Considering useful and successful exchange and collaboration between than in the field of information and communications technology (hereinafter referred to as ICT) and,
Desiring to promote and enhance their cooperation and exchanges in the field of ICT with a view to further enhancing the development and adoption of ICT,
have agreed as follows :

Article 1
Scope of collaboration
1. The two Parties shall endeavor to collaborate in the field of ICT in accordance with this Memorandum and their national legislations and within their competence. The Parties shall jointly identify projects of Information and Communications Technology for collaboration in achieving them.
2. The Parties may, for each ICT project identified in accordance with Paragraph (1) of this Article, determine the scope of collaboration which shall include:
a) sharing the experience and knowledge available to each of them; and
(b) collaborating on the implementation of such ICT projects, where possible.

Article 2
Sharing of experience
1. Either Party may, upon the request of the other Party, share its relevant experience in relation to a suitable project.
2. The sharing of experience may take the form of among others, study visits or knowledge transfer by the Parties.

Article 3
Implementation of ICT projects
1. Implementation of a specific ICT project under this Article shall be subject to the Parties, within the limits of the respective laws in force in each of the two countries, entering into a prior separate written agreement on the matters, terms and conditions required for such implementation.
2. Where the Parties agreed to implement an ICT project under Paragraph (1) of this Article, Ministry of Information and Communications Technology shall;
(a) engage the relevant public stakeholders, from Government agencies and public authorities, in the project of Information and Communications Technology to overcome any project issues at these agencies and public authorities.
(b) undertake such other tasks and responsibilities as may be set out in the agreement concerning the project referred to in Paragraph (1) of this Article.
3. The Parties understand that the finalization and execution of any separate agreement under this Article shall:
(a) For the Ministry of Information and Communications Technology, is subject to the Ministry of Information and Communications Technology internal policies and regulations as well as legal and procedural requirements of the Government agencies and public authorities in the State of Qatar.
(b) for the Ministry of Communications and High Technologies of the Republic of Azerbaijan, be subject to the national legislation of the Republic of Azerbaijan.

Article 4
Costs, expenses and resources
Without prejudice to any written agreement between the two Parties, each Party shall, bear its own costs and expenses and provide its own resources for the implementation of this Memorandum and any matters related thereto.

Article 5
Dispute settlement
The Parties shall settle any dispute or disagreement, arising from this Memorandum or from its implementation or interpretation, amicably through consultations and negotiations in good faith.

Article 6
Publicity
All publicity and media activities relating to the scope of the activities mentioned in this Memorandum shall be planned, coordinated and executed jointly by the Parties.

Article 7
Amendment
Any additions and amendments can be made to this Memorandum by mutual consent of the Parties. Such additions and amendments shall be made in a form of separate Protocols being an integral part of this Memorandum and shall enter into force in accordance with the provisions of Article 8 of this Memorandum.

ARTICLE 8
Entry into force of the memorandum
1. This Memorandum shall enter into force on the date of receipt by the Parties of the last written notification, through diplomatic channels, informing the completion of the internal procedures required for the entry into force of this Memorandum in the two countries, and shall remain into force for a period of three (3) years. The Memorandum shall be automatically renewed for other similar period or periods unless either of the Parties, at least three (3) months prior to its termination or expiration notifies the other Party in writing, through diplomatic channels, of its intention to terminate this Memorandum.
2. Termination or expiration of this Memorandum shall not affect the existing or ongoing programs or activities unless the Parties otherwise agree.

IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective governments, has signed this Memorandum.
Done at Doha, on 08/12/2014 corresponding to 16/02/1436 AH, in duplicate, each in Arabic, Azerbaijani and English languages, all texts being equally authentic. In case of divergence in interpretation, the English text shall prevail.
