Chapter Four The Courts' General Assemblies and Ad Hoc Committees
17 Article
Each Court shall have a General Assembly. Each Assembly shall convene at the invitation of the President of the Court, or anyone acting on his behalf, whether ex
mero motu
or in accordance with a request by at least one third of the members, to consider the following issues:
The formation of circuits.
The allocation of cases to the different circuits.
Specifying the number of hearings and the dates thereof.
Organizing the work during the judicial vacation, and defining the issues to be considered.
Other issues relating to the internal affairs of the Court.
Any other issue which the law ascribes to it or which the Council assigns to it.
The General Assembly shall be permitted to delegate certain of its competences to the President of the Court.
18 Article
The General Assembly of the Court shall consist of all of the members thereof, and the President of the Court shall preside over the Assembly.
The Assembly shall not be deemed valid unless more than half of the members are present. If this quorum is not attained, the Assembly may validly convene after the lapse of one hour from the time appointed if at least one third of the members are present.
Where this quorum is not attained, the General Assembly may validly reconvene within one week regardless of the number of members present.
19 Article
Resolutions of the General Assembly shall be issued by majority vote of the members present. In the event of a tie the President shall cast the deciding vote.
The minutes of the General Assembly shall be certified in the record and shall be signed by the President and the Secretary.
20 Article
The General Assembly shall form in each Court a three-person committee called the “Interim Affairs Committee” comprising the President of the Court or his appointed delegate as its president and the two most senior members of the Assembly.
The committee shall have authority over the terms of reference of the General Assembly in urgent matters where it cannot be convened.
21 Article
The resolutions of the General Assembly and of the Interim Affairs Committee shall be submitted to the Council.
The Council may remit to the General Assembly or to the Committee for reconsideration any resolutions which it deems inappropriate.
Where either the Assembly or the Committee insists on its original decision, the Council may proceed as it deems necessary and its resolution shall be final.
