Articles
1 Article
The Ministry of
Finance, Economy and Commerce
, hereinafter “the Ministry”, shall be organised and its competencies shall be assigned as set out in this Law.
2 Article
In addition to the general competencies set out in the aforesaid
Law No. 5 of 1970
, the Ministry of
Finance, Economy and Commerce
shall assume the following competencies:
Proposing the objectives and instruments of the economic policy and its related financial and commercial policies.
Preparing and implementing the general budget of the State.
Supervising the economic and commercial activity and heading them in accordance with the requirements of national development.
Collecting taxes and duties in accordance with the law.
Investing the State's reserves.
Setting up and implementing customs policy.
Protecting the consumer and proposing, implementing and monitoring specifications, standards, weights and measures.
Developing international economic, financial and commercial relations between the State of Qatar and other countries.
Proposing draft laws and bylaws relating to the competencies of the Ministry.
3 Article
Subject to the general duties of the Minister in accordance with the provisions of the
aforesaid
Law No. 5 of 1970
, the Minister shall assume the following duties:
Supervising the management of the Ministry's affairs generally and its methods of carrying out its competencies.
Issuing the resolutions necessary to regulate the function of the Ministry.
Representing the State at conferences, authorities, and regional and international organisations within the field of the Ministry's activity.
4 Article
The Minister shall have an office director under him directly who shall assume the following duties:
Organising the files, correspondence and papers in the Minister's office.
Receiving correspondence addressed to the Minister and preparing the same for presentation to him.
Distributing the aforesaid correspondence to the competent bodies for review in accordance with the instructions of the Minister.
Preparing the memorandums and correspondence assigned to him by the Minister.
Liaising with various bodies with respect to providing the required documents and details.
Notifying the competent bodies of the Minister's endorsements and instructions and briefing the Minister on the status thereof.
Attending interviews and discussions that he is allowed to attend by the Minister and recording what he directs him to.
5 Article
The Planning and Follow-up Unit at the Ministry shall be undertake the competencies stipulated in
Emiri Resolution No. 4 of 1989
establishing the Supreme Council for Planning, which shall be formed by a resolution of the Minister.
6 Article
Subject to the general duties of the undersecretary in accordance with the provisions of the
aforesaid
Law No. 5 of 1970
and
Emiri Resolution No. 8 of 1979
, the undersecretary shall assume the following duties:
Proposing the draft bylaws and resolutions regulating the functions of the Ministry or executing its competencies.
Approving expense and financial documents in accordance with the provisions of the financial regulations.
Proposing to amend the administrative units comprising the Ministry, in addition to determine and amend the competencies thereof.
Supervising the work of the Qatar Chamber of Commerce and Industry, and the office for the boycott of Israel in accordance with law.
The undersecretary may delegate some of his duties to the assistants' undersecretary or managers of the
administrative units
at the Ministry.
7 Article
The Ministry of Finance, Economy and Commerce shall consist of the following administrative units:
Department of
Public Financial Affairs.
Department of Customs.
Department of Economic Affairs.
Department of Commercial Affairs.
Department of Specifications, Standards and Consumer Protection.
Department of Administrative and Financial Affairs.
Department of Income Tax.
Investments Office of the Government of the State of Qatar.
Computer Unit.
8 Article
Each Department of the departments of the Ministry shall be headed by a director who shall be directly responsible to the undersecretary. Each director shall assume the following duties:
Discharging the affairs of the department and following up its work progress, and coordinating with its sections and offices that affiliated to the department.
Proposing resolutions required for the development of the department's activity.
Preparing the draft budget of the department.
Adopting resolutions and signing various transactions that fall within the duties thereof.
9 Article
The Department of
Public Financial Affairs shall be responsible for
all matters relating to public finance and State general budget, in particular the following:
Implementing the provisions of laws, resolutions, bylaws and regulations relating to the State public finance.
Issuing the annual publication which shall include rules, instructions, and guidelines that shall be followed for the preparation of the State annual budget.
Reviewing draft budgets prepared by the ministries and other government bodies, and preparing the draft State general budget.
Monitoring the implementation of the general budget from revenue and expense aspects, and all financial liabilities with which the State linked.
Studying applications related to the additional appropriations and transfer among the parts and items of the budget.
Taking the necessary procedures for opening bank credits and following up such procedures.
Collecting the State revenues according to the law.
Preparing draft financial bylaws for the budget and accounts and issuing publications relating to interpretation thereof and how to apply them.
Addressing all financial matters of the State and following up the implementation of decisions issued thereon.
Arranging the internal and external financing required for the State development plans, and serving and following up payable and receivable loans.
Keeping and auditing all State accounts.
Preparing the final account of the State.
Preparing periodic reports on the State's financial status.
Preparing studies and research necessary for setting up and developing the public financial policy of the State.
10 Article
The
Department of Customs shall be responsible for
all matters relating to customs affairs, in particular the following:
Implementing the provisions of customs laws, resolutions, bylaws and regulations.
Controlling all types of goods imported to the country by land, sea or air, at the customs ports of the State.
Previewing, valuing and clearing goods permitted to enter the country, collecting customs duties and taxes due in accordance with the provisions of the tariff in force, and supplying the same to the public treasury of the State.
Controlling exported goods, and issuing licences for such goods.
Controlling import and export of goods within the postal parcels.
Issuing permits for goods in transit (direct and indirect transit) and following up the supervision over them till be re-exported, and collecting transit fees prescribed by law.
Supervising the free zones, warehouses, and duty free markets within their own regulations.
Issuing permits relating to the temporary entry system for imported goods with a view to re-manufacturing or completing their manufacture, as well as to cars and other items and goods that may be entered into the country in accordance with such system.
Issuing decisions relating to the additional conditions and applied conditions of the customs tariff.
Issuing licences for customs brokers and monitoring their works.
Taking all actions and measures to prevent the customs smuggling.
Conducting the compounding on customs offences and customs smuggling offenses, in accordance with the settlement guide.
Taking proceedings of administrative and judicial prosecution for customs offences and customs smuggling offences which cannot be compounded.
Following up procedures of selling goods that are seized, and those goods that their keeping period in the customs stores or in the yards of the Customs Department has been elapsed, and disposing the proceeds of sale in accordance with law.
11 Article
The
Department of Economic Affairs shall be responsible for
all matters relating to economic issues, in particular the following:
Collecting and analysing statistics necessary for study of the means of support and development of the national economy, with taking into consideration the competencies of the Central Statistics Bureau.
Finding executive means to implement economic policies and their future orientation, in accordance with the objectives of the development plans of the State
.
Proposing the means for development of foreign trade, especially the rationalisation of imports and diversification of export and their geographical distribution on the regional and international levels
, and promoting national products in the foreign markets.
Proposing to implement decisions of participation in international exhibitions and markets, organising the international exhibitions held in Qatar, and supervising the local exhibitions.
Following up the works of the Arab, Islamic and international economic organisations, and preparing the necessary reports on their activities.
Studying and analysing draft international economic agreements concluded between the State of Qatar and others and following up their implementation, and preparing reports on the development of economic relations arising from such agreements in order to serve the objectives of the State development plans.
Working on conducting the feasibility studies for economic projects that the State owned them or has shares therein and assessing such studies.
Preparing draft economic laws, bylaw and resolutions.
Assessing the results of the implementation of economic policies, plans and laws, and suggesting ways to overcome their obstacles.
12 Article
- Amended
The
Department of Commercial Affairs shall be responsible for
all matters relating to commercial issues, in particular the following:
Implementing the provisions of laws, bylaws, resolutions and regulations relating to the commercial register, investment of non-Qatari capital in economic activity, business of the commercial agents, and licences for the
practice of business and companies
, and supervising and controlling of insurance companies and agents, trademarks, trade indications and regulating the profession of auditing.
Keeping the commercial register, issuing trade licences, and conducting registrations of commercial agents, importers, contractors and craftsmen, and inspecting activities thereof.
Registering trademarks, keeping their records, publishing them in the periodical newspaper and collecting fees payable
.
Supervising the establishment of companies and inspecting them,
especially shareholding companies,
and issuing the necessary decrees for establishment thereof and for companies that are excluded from the Law of
investment of non-Qatari capital in the economic activity.
Supervising the activities of the national insurance companies and branches of foreign companies, and issuing the annual publication of the insurance activity in the State of Qatar.
Supervising registration of accountants in auditing offices and their works
.
Preparing the necessary commercial studies and research to develop the internal trade policy of the State.
Receiving patent applications in the State of Qatar, examining them initially, meeting their requirements and following up their registration in the Patent Office of the Gulf Cooperation Council.
13 Article
The
Department of Specifications, Standards and Consumer Protection shall be responsible for
all matters relating to
specifications, standards and prices
, in particular the following:
Implementing the provisions of laws, bylaws, resolutions and regulations related to the monitoring, examination and hallmarking of precious metals, the standardisation of weights and measures
, the system of standards and specifications, the mandatory pricing and fixing profits, and the combating of fraud in commercial transactions.
Preparing and issuing Qatari standard specifications, proposing its annual plan, following up the work of the General Secretariat of the Gulf Authority in this regard, and taking related executive and media procedures.
Determining and controlling the prices of goods and materials and their profits in the markets, and monitoring their work systems
.
Issuing certificates of conformance with standard specifications for goods produced locally, imported or exported, and issuing quality marks for local products.
Inspecting markets and verifying compliance with the provisions of legislations that aim to protect the consumer
.
Monitoring the validity of commercial data specifications and the compatibility of the products traded in the markets with such specifications.
Conducting research and studies related to the development of local production to match the adopted standard specifications in coordination with the concerned bodies.
Representing the Ministry in all standardisation activities carried out by the international organisations concerned with the specifications and standards.
14 Article
The Department of Administrative and Financial Affairs shall be responsible for the following:
Implementing all administrative regulations and bylaws.
Implementing procedures relating to personnel affairs.
Identifying the Ministry's needs of posts and manpower in coordination with the other administrative units.
Determining the training needs of the Ministry's staff in coordination with other administrative units.
Providing supplies and equipment required by the Ministry and its various administrative units to perform their functions
.
Preparing the Ministry's draft budget and following up implementation thereof.
Carrying out the public relations affairs of the Ministry.
15 Article
The Department of Income Tax shall be responsible for the implementation of the provisions of taxes laws, resolutions and bylaws.
16 Article
The Investment Office of the Government of the State of Qatar shall be responsible for the implementation of decisions related to the State reserve investment.
17 Article
The Computer Unit shall be responsible for programming, saving, retrieving and modifying the information and data systems for the administrative units at the Ministry in accordance with the Ministry's needs.
18 Article
The Council of Ministers may, upon a proposal from the Minister, amend the organisation of the administrative units comprising the Ministry by addition, cancellation and merging, and may assign or amend their competencies.
19 Article
Sections in the administrative units which comprise the Ministry may be established, abolished and merged as required by the public interest and their competencies may be determined and amended by a resolution of the Minister.
20 Article
The Minister shall issue the necessary bylaws and resolutions to implement the provisions of this Law.
21 Article
The aforesaid
Law No. 6 of 1989
and Resolution No. 13 of 1965 of the Deputy Ruler, and each provision that violates the provisions of this Decree-Law shall be rescinded.
22 Article
All competent authorities, each within its own jurisdiction, shall enforce this Law which shall come into force from the date of its publication in the
Official Gazette.
