(Repealed)
Where the debt is determinable, the debtor may not pay any substitution without acceptance of the creditor, even if such substitution has the same value of the thing which is due, or even if it's higher in price. Where the debt is undeterminable and has been specified in the contract, the debtor may pay what may be the same irrespective of the creditor's rejection.

In case the creditor acquires an offer of the same sort of his right or thing from his debtor that has the same description, he may retain it.

(Repealed)
In case payment of the debt is due, debtor can not force his creditor to take some and leave some of the debt, even if such debt can be paid in parts.

170 Article
(Repealed)
Where the debt is deferred or agreed to be given in definite instalments, the creditor may only demand payment of the debt or installment on the due date. Where the debet is not deferred, and due, the debt shall be paid immediately. Nonwithstanding, provided that the creditor is held harmless, the court, if not stipulated otherwise may, if necessary, -and if the debtor circumstances so require - reasonably extend the due date.

In case of deffered debt, the debtor may settle the debt prior its due date if it's in his interest and the creditor shall have to accept.

(Repealed)
Fungibles which are assessed
inter alia
by quantity, weight or
offers and have a place, and the contract is undefined i.e. not specifying the place of delivery; such things shall be delivered in the place where it was existing at the time of contract.
For other obligations, fulfilment or repayment shall be effected in the domicile of the debtor on the due time or in the place of his business in case obligations are related to such businesses, unless otherwise agreed.

(Repealed)
In case debtor sends amount of debts to the creditor through a messenger and said debt lost while in the messenger hands before reaching to the creditor, such lost amounts shall be considered as lost from the debtor. While, should the amount of debts be sent through the messenger of the creditor and upon his request to the debtor and if it lost in his hands, such amount shall be considered as lost from the creditor and debtor shall be considered as discharged.

Expenses of fulfilment are paid by the debtor, unless otherwise agreed or applicable by customs or by means of a stipulation.
