1 Article
In the application of the provisions of this Law, the word “weapon” means firearms or any part thereof, ammunitions, explosives of all kinds and any material used in their composition
2 Article
The possession, acquisition, manufacture, repair, trade or import of
weapons shall be prohibited without first obtaining a license from the Police Chief or his deputy after approval of the Deputy Ruler.
3 Article
The Police Chief or his deputy, after approval of the Deputy Ruler, may grant, reject, withdraw, cancel or restrict in any way he deems the licence referred to in
Article 2
.
The licence shall be valid from the date of grant to the last day of Dull Hijjah of the year in which it granted,
and may be renewed annually as of the first of Muharram of each year, before two months of the expiry date of the license period.
4 Article
A. No licensed weapons shall be carried in public places.
B.
In the application of the provisions of previous paragraph, “
public places” means squares, public roads, markets, industrial and commercial shops, and other gathering places located within the city boundaries.
5 Article
A. A fee of fifty Riyals shall be imposed on each licence of possession or acquisition of any weapon and on each renewal thereof.
B. A fee of five Riyals shall be imposed on giving replacement of lost or damaged licence.
6 Article
No licensed weapon may be handed over to a third party for possessing or acquiring it prior obtaining a licence in accordance with the provisions of
Article 2
hereof.
7 Article
In case of loss of a licensed weapon, the licence holder shall notify the police department immediately after his knowledge of such loss.
8 Article
In case of death of the licensee to possess or acquire a weapon, his heirs who have knowledge of the existence of such
weapon shall surrender this weapon to the respective police jurisdiction in his place of residence
9 Article
In case of withdrawal of the licence before the expiry date, the owner of the weapon shall surrender it immediately to the police department
10 Article
The owner of the surrendered weapon to the police department or his heirs shall have the right to dispose it by sale or by other actions to a person licensed to possess or trade in weapon during one year from the date of delivery; otherwise ownership of weapon shall be deemed
relinquished
to the government without compensation.
11 Article
No licence stipulated in Article 2 hereof shall be granted to the following:
Persons under twenty-one (21) calendar years of age.
Persons sentenced to imprisonment for at least one year for assault, or damage to property, or an offence of drugs trafficking.
Persons
convicted of an offense involving the security of the country or system of government.
Persons convicted of any offence in which the weapon was used or if the offender was carrying a weapon during its commission.
Persons previously admitted a mental hospital or health facility.
12 Article
The provisions of this Law shall not apply to weapons delivered by the Government to police and general security personnel permitted to carry such weapons by applicable regulations.
13 Article
Any person in possession, trade, import, manufacture, or repair of weapons shall, within one month of the entry into force of this Law, submit an application to the Police Chief
showing the amount and kind of existing weapons
to obtain the required licence.
Where application to license such weapons or parts thereof is rejected, such person shall surrender the weapons to the police department immediately after being notified of the rejection and the police department shall
give appropriate compensation for each weapon surrendered to it.
14 Article
Any person licensed to trade, manufacture or import weapons shall keep two records,
one to note with serial numbers all of his weapons with a statement of their price, parties from which he received and necessary details, and the another to note with serial numbers what sold of them, the price, the registered number in the first record, the name of buyer, title, profession, and place of residence, and the licence number.
A sheet in both records shall be sealed by the police department and the police may request these records and review them at any time.
15 Article
Any person
licensed to repair weapons shall keep a record on the manner set forth in the preceding Article to note each weapon or parts thereof which he received for repair, the name of owner, the licence number, the date of deliver and his signature.
All provisions of the preceding Article shall apply to this record.
16 Article
Licences; their application, renewal, and records stipulated in this Law shall be prepared in accordance with forms set by the police department.
17 Article
The Police Chief or any officer whose rank is not less than Inspector First shall have the right at any time to enter shops prepared for trade, manufacture or repair weapons and carry out an inspection to verify implementation of the provisions of this Law.
They also shall have the right to request and examine the commercial books and other documents, records, invoices and papers relating to the import, possession, manufacture or repair of various weapons.
18 Article
Dwellings, private shops or transportation means shall not be inspected for firearms only after obtaining permit from the Deputy Ruler. With exception to this provision, the Police Chief or any officer whose rank is not less than Inspector First may conduct inspection in the following cases:
Case of flagrante delicto.
Case of committing an offence of assault on a person or damage to property in which a weapon used.
19 Article
Without prejudice to any severer penalty provided for by another law:
Each one who violates the provisions of Articles
2
,
6
, and
13
of this Law shall be punished by imprisonment for a period not more than five years and a fine not more than five thousand Riyals, or either of them.
In all cases, weapons seized pursuant to an offence shall be confiscated.
Any other violation of the provisions of this Law shall be punishable by imprisonment for a period not more than one year and a fine not more than one thousand Riyals, or either of them.
In all cases, licence may be withdrawn and weapons may be confiscated.
20 Article
All competent authorities, each within its own jurisdiction, shall enforce this Law which shall come into force from the date of its publication in the
Official Gazette
.
