4- To what extent is the employee who is a member of more than one committee at a time can get from the compensation bonus in the light of the rules in the Council of Ministers Resolution No., (9) 1993 and its amendments hereinafter?
Finding:
The compensation bonus for any employee shall not exceed three thousand riyals in total at once per month.
Reasoning:
It is comprehended from the provisions of section (13, 14, 16) of the Council of Ministers Resolution No., (9) 1993, as amended by the Resolution No., (7) 1995 with regard to the regulations for the joint and the specialized committees and both sections (6, 15) of the Prince Decree No., (33) 2000 that caters for the procedure of legislation preparation, and the sections (1, 5, 7) of the Council of Ministers Resolution No., (16) 2002 that provided for the constitution of the Permanent committee for the Nationality Affairs. In this law it is stipulated that for any compensation bonus to be granted there must be many conditions to satisfied in anticipation, some of which that the committee must be formed by a Council of Ministers Resolution or by a higher legislative body and its meetings should not be in the working hours time. Also this permanent committee meetings shall at least convene not less than four times per month. Moreover the members shall not be completely devoted to the performance of the task, in other words, the task to be performed by the committee must be in addition to the main job of the member.
The determination of the compensation must be fixed by the Resolution that formed the committee, or otherwise it should be paid according to the general rules that regulate such payment. It is necessary to note that the compensation bonus should by no means exceed “three thousand” riyals however these committees have become more than one or have become of varied qualities or functions. The Council of Ministers Resolution does not apply to the meetings of the Board of Directors of companies, Institution, corporations and stock companies that are government owned entities or the government has share in it.
This Decree is a general one with a view to regularize the work performed by the committees which have been formed by the Council of Ministers Resolution or by any higher authoritative legislative body, such as a Decree from the Ameer, (Prince) or a legislation by a legislative body, if the legislator wanted to exempt any committee from the operation of this law, then this is open to be included in the Resolution of the formation of the committee clearly or otherwise it is also open to determine whatever compensation bonus the legislative body may think reasonable and fit.
In application to the above stated law to the facts that the Applicant is a member of the following committees:
- The Permanent Committee for Legislative Affairs, and he is paid (3.000) three thousand riyals per month.
- The Permanent Committee for Qatari Nationality, and he is paid (2.000) two thousand riyals per month.
Whereas, both of the compensation bonus refereed to above are subject to the rules of the Council of Ministers Resolution No., (9) 1993 abovementioned and its amendments thereinafter, therefore, it is not permissible for the compensation bonus of the Applicant to exceed (3.000) three thousand riyals per month. This must not be looked at as if the importance of the permanent. Committee for the Legislation Affairs has been exaggerated by virtue of its being formed by the (Ameer) Prince Decree the same as the Permanent Committee for the Legislation Affairs.
Therefore, the compensation bonus for any employee shall not exceed (3.000) three thousand riyals and the Applicant shall not be paid more than that in his being a member of both committees.
