28- Housing

Finding:

After the commencement and the promulgation of the Resolution by the Council of the Ministers No., (5) 1984, it has not become allowable for the combination of both the benefit of having the Public Housing and having the Senior Officials Housing simultaneously.

Reasoning:

In accordance to the Article No., (2) of the Council of the Ministers No., (5) 1984 that has catered for the regulations that were set for the combination of both the benefit of getting the Public Housing and of getting the Qatari Senior Officials Housing, in this case the employee who has got the public housing and later on has been promoted to the Senior officials grade, he will then be entitled to benefit of the rules pertaining to the Qatari Senior  Officials law provided that the conditions with regard to it subsequently have squarely been satisfied. Accordingly he will be awarded the financial facility loan without granting him a plot of land in case he opted to keep the public housing plot of land which has been already in his lands. Therefore, it is not allowable for anyone to continue having in one’s hand both benefits of the Public Housing and the Senior Officials Housing except in the cases which has been already finalized before the commencement and the applicability of the Council of the Ministers’ Resolution exactly as is provided by the law in consonance with the rule in Article (1) of the same.
